1.-Cancellation of Shared & Private tours:

For all whale shark encounter bookings operated by Whale Shark Adventures on shared and private tours

80% will be refunded. 20% is non-refundable, as this represents our direct cost of booking and preparing your tour.

Cancellations with less than 2 days notice:
No refund will be given if tours are cancelled with less than 2 days notice, as Whale Shark Adventures will be charged for all costs such as guides, transport etc.

2.-Cancellation of Multi-day / Groups / Custom / VIP tours:

As we start to incur costs from the time the contract is confirmed we will apply cancellation charges as shown below from the time when written notification of the cancellation is received

Cancellations with more than 1 month notice:

80% will be refunded. 20% is non-refundable, as this represents our direct cost of booking and preparing your tour.

Cancellations with less than 7 days notice:

50% will be refunded. 50% is non-refundable, as this represents our direct cost of cancelling any arrangements made for your tour.

Cancellations with less than 2 days notice:

No refund will be given if tours are cancelled with less than 2 days notice, as Whale Shark Adventures will be charged for all costs such as guides, transport etc.

3.-A few words about travel insurance:

As with any and all world travel, we strongly recommend that you buy a travel insurance policy in your home country that covers your cost should you have to cancel on short notice. This kind of travel insurance is not expensive and frequently covers other risks. In general, travel insurances are a good idea to have when you are on the move in the world.

4.-A few words about the weather and conditions:

All adventure trips and outdoor activities are weather and condition dependent and we reserve the right to change your itinerary or cancel your trip with your safety in mind. Our guides are specially trained to deal with changing conditions and their number one priority is to make decisions with your safety in mind. Please be aware of this and respect your guides authority to do so. Our summer trips, operated from June through August, are rarely adversely affected by harsh weather.

5.-A few words about “assumed risk” and outdoor activities:

Guests/Clients are advised that all activities are undertaken entirely at their own risk and they must behave in a fit and proper manner at all times in accordance with Whale Shark Adventures guidelines and must take proper responsibility for their own safety. All adventure tours and outdoor activities carry inherent risks and Whale Shark Adventures do not assume any responsibility for accidents that are caused by its customers or can be traced to their own actions or are caused by factors outside of human control (Force majeure). With the purchase of your trip you agree to these conditions, understand its implications and accept responsibility for your participation in your trip. Depending on the excursion, you may be requested to sign an additional liability release.

6.-Alcohol and drugs:

We reserve the right to refuse participation to clients we believe are under the influence of alcohol or drugs, in such circumstances, no refunds shall be given. Our guides reserve the right to refuse participation to any customer whose conduct or manner is likely to cause offence, upset or put other passengers in danger. In such cases, full cancellation charges apply.

IMPORTANT: We can’t guarantee  swimming with the Whale Sharks, unproper weather conditions and unknown precise feeding patterns lowers our chances to spot them, although we have 99% success rate from mid june to september as massive congregations of whale sharks wander around the same area everyday we cant unfortunately guarantee a whale shark sighting.
